Terms of Service

Teamcade is a free browser game you can start without an account. These terms are the agreement between you and us while you use it — what the Service is, what we ask of you, and the limits of what we can promise.

01Who we are and what this covers

PrimeHammer s.r.o. (“we”, “our”, “us”), a company registered in the Czech Republic, operates the Teamcade website and web application (the “Service”). These Terms of Service (the “Terms”) govern your use of it.

By opening a room, joining a room, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

02The Service

Teamcade lets you create a room, share a link, and play short multiplayer games in the browser with the people who join. There are no player accounts: you choose a display name and play.

Rooms are temporary. They exist in server memory while they are in use and are discarded when they empty. Nothing you do in a room is stored for you to come back to, and we do not promise that any game, score or room will still be there later.

The Service is offered as it is at any given moment. We may add, change, suspend or remove games and features, and we may change how the Service works, at any time and without notice.

03Who may use it

The Service is made for workplace teams and is not directed at children under 16. If you are under 16, please do not use it.

If you use the Service as part of your work, you confirm that you are allowed to do so by whoever you work for.

04Acceptable use

Anyone with a room link can join that room, so a room is only as private as the link. Please use the Service considerately. You agree not to:

You are responsible for what you send through the Service. Because rooms are not stored, we generally cannot review, moderate or recover what is said or drawn in one; if someone in your room is behaving badly, leave the room and, if you want to report it, contact us.

05Your content

What you type and draw during a game stays yours. You give us permission to relay it to the other players in your room and to display it there, which is what makes the game work. That permission lasts only as long as it takes to run the game, and we claim no other rights in it.

06Our content

The Service — including its games, artwork, sounds, text, layout and code, and the Teamcade name and logo — belongs to us or to our licensors and is protected by intellectual property law. You may use it to play. You may not copy, adapt, redistribute or reverse engineer it beyond what the law allows without our written permission.

07Price

The Service is currently free to use, with no payment method required. We may introduce paid plans in future; if we do, we will make clear what is paid before you are asked to pay for anything, and using the free part of the Service will never charge you automatically.

08Availability

We do our best to keep the Service running, but we do not promise that it will be available, uninterrupted or error-free. It may be unavailable during maintenance, during a failure at our hosting provider, or for reasons outside our control, and rooms in progress may end when that happens.

Playing needs a modern browser and a working internet connection, which are your responsibility.

09Suspension

We may restrict or block access to the Service — for a person, a room or an address — if we reasonably believe these Terms are being broken, or to protect the Service and the people using it. As there are no accounts, this is normally a technical measure rather than something we can apply to you personally.

10Third-party services

The Service is delivered with the help of other providers, including our hosting provider and the content delivery networks that serve fonts and code libraries. Their own terms and privacy practices apply to what they do, and we are not responsible for services we do not control. Links to other websites are provided for convenience only.

11Privacy

How we handle personal data is set out in our Privacy Policy, which forms part of these Terms.

12Disclaimer and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, goodwill or business opportunity, arising from your use of the Service. Because the Service is free, our total liability to you for any claim connected with it is limited to EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct. If you use the Service as a consumer, your statutory rights are unaffected.

13Changes to these Terms

We may update these Terms when the Service or the law changes. The revised version is posted here with a new “last updated” date, and it takes effect when posted. Continuing to use the Service after a change means you accept the updated Terms.

14Governing law

These Terms are governed by the laws of the Czech Republic, and the courts of the Czech Republic have jurisdiction over any dispute arising from them. If you use the Service as a consumer resident in the European Union, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

If any provision of these Terms is found unenforceable, the rest stays in force.
